\nsubsidiaries (hereinafter collectively referred to as \u201cONE\u201d) Acceptable Use Policy (\u201cAUP\u201d) is to
\nestablish acceptable practices regarding the use of ONE\u2019s various telecommunication services offered by
\nONE (individually \u201cthe Service\u201d and collectively \u201cthe Services\u201d)\u00a0in order to protect the
\nconfidentiality, integrity and availability of information created, collected, and maintained.This AUP
\napplies to ONE\u2019s services that (i) provide or include access to the Internet, including Warp Drive
\nservices, hosting services, or are provided over the Internet or wireless data networks (collectively,
\n\u201cBroadband Service\u201d), (ii) provide or include access to the public telephone switching network,
\nincluding business lines, residential lines, PRIs and voicemail (collectively, \u201cVoice Services\u201d), and
\n(iii) provide or include communications services through cloud-based services, including hosted PBXs,
\ncontact center services and cloud-based voicemail.<\/p>\n
\nby ONE. By using the Services (defined as any telecommunication services provided by ONE), the Customer
\nagrees to comply with the terms of this AUP and to be responsible for all users utilizing the Services.
\nONE reserves the right to change or modify the terms of the AUP at any time, effective when a revised
\nversion of the AUP is provided to Customer or when posted on ONE\u2019s website, whichever is earlier. The
\nCustomer’s use of the Services after changes to the AUP are posted shall constitute acceptance of any
\nchanged or additional terms. You, the customer, must comply with this AUP. Your failure to do so could
\nresult in the suspension or termination of your Service subscription(s). If you do not agree to comply
\nwith this AUP, you must immediately stop all use of the Service and notify ONE so that we can close your
\naccount<\/p>\n
\nlawful purposes. Access, transmission, distribution, storage or export of any material in violation of
\nany applicable law or regulation is prohibited.<\/p>\n
\nthe rights of others, or interfere with or diminish the use and enjoyment of the Service(s) by others.<\/p>\n\n
\nintent, purpose or knowledge, to use or enjoy the Service(s) (except for safety and security functions

\nperformance degradation, regardless of intent, purpose or knowledge, to the Service or any ONE\u2019s (or
\nONE\u2019s Suppliers) host, server, backbone network, node or service;<\/li>\n
\nService (for example, through Wi-Fi or other methods of networking), in whole or in part, directly or
\nindirectly;<\/li>\n
\nincluding, without limitation, denial of service attacks, flooding of a network, overloading a
\nservice, improper seizing and abusing operator privileges, and attempts to \u201ccrash\u201d a host; and<\/li>\n
\naddress.<\/li>\n<\/ul>\n
\npublish, submit\/receive, upload\/download, post, use, copy or otherwise reproduce, transmit, re-transmit,
\ndistribute or store any content\/material or to engage in any activity that infringes, misappropriates or
\notherwise violates the intellectual property rights or privacy or publicity rights of any individual,
\ngroup or entity, including but not limited to any rights protected by any copyright, patent, trademark
\nlaws, trade secret, trade dress, right of privacy, right of publicity, moral rights or other
\nintellectual property right now known or later recognized by statute, judicial decision or regulation.<\/p>\n
\nor re-transmit any content or material (or to create a domain name or operate from a domain name), that
\nharasses, threatens the health or safety of others, is obscene, or defamatory.<\/p>\n

\nVIOLATIONS OF THE POLICY BY THE CUSTOMER.<\/p>\n
\nCUSTOMER OR AN END USER OF THE CUSTOMER ARE A MATERIAL BREACH AND DEFAULT OF THE APPLICABLE SERVICE
\nAGREEMENT BETWEEN ONE AND CUSTOMER.<\/p>\n

\nETC., EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ONE SHALL NOT BE LIABLE FOR ANY DIRECT OR
\nACTUAL DAMAGES, EXCEPT TO THE EXTENT SPECIFIED IN A WRITTEN OR ELECTRONIC AGREEMENT ENTERED INTO BETWEEN
\nONE\u00a0AND ITS CUSTOMER. OTHER LIMITATIONS OF LIABILITY ARE INCLUDED HERE BY REFERENCE INCLUDING THE
\nTERMS OF USE AND PRIVACY POLICY OF THE ONE.<\/p>\n
\nAND EXPRESSLY DISCLAIMS WARRANTIES OF FITNESS FOR A PARTICULAR USE OR PURPOSE, THE WARRANTY OF
\nMERCHANTABILITY AND ANY OTHER WARRANTY IMPLIED BY LAW.<\/p>\n
\ndirectors, employees, agents, licensors, consultants, suppliers, and any third- party Web site providers
\nharmless from and against all claims, demands, actions, liabilities, losses, expenses, damages, and
\ncosts, including actual attorneys’ fees, resulting from your violation of this AUP, misuse or abuse of
\nthe Services, or your infringement, or infringement by any other user of your account, of any
\nintellectual property or other right of any person or entity. You will cooperate as fully as reasonably
\nrequired in ONE\u2019s defense of any claim in this regard. ONE reserves the right to assume the exclusive
\ndefense and control of any matter otherwise subject to ONE. You agree immediately to notify ONE of any
